These Terms of Use and Service govern the use of the noirparfum.com website operated by MANDEV KOZMETİK SANAYİ VE TİCARET LİMİTED ŞİRKETİ. By using the site, you agree to act in accordance with applicable law and these terms.

2. USE OF THE SITE

The site may only be used for lawful purposes. No action may be taken that could harm the site, other users or third parties, or disrupt security, operation or data integrity.

Transmitting viruses or malicious code, attempting unauthorised access, using false identity or payment details, generating excessive traffic by automated means and collecting site content for commercial purposes without permission are prohibited.

3. ACCOUNT AND ACCOUNT SECURITY

Information provided when creating an account must be accurate and up to date. Protecting the password and account access details is the user's responsibility. Any unauthorised use must be reported to us without delay.

If unlawful use, fraud or a security breach is detected, account access may be temporarily restricted. The user's existing order and consumer rights are reserved.

4. PRODUCT INFORMATION AND IMAGES

The main characteristics, volume, ingredients and usage information of products are shown on the relevant product page. Due to screen settings, lighting and packaging production differences, the colour or appearance of a product may differ slightly from what is shown on screen.

Due care is taken to keep product information accurate and up to date. If an obvious material error is found, the user is informed before the order is processed; the user may confirm the order or cancel it and receive a full refund.

5. PRICE, STOCK AND ORDERS

Prices are shown in Turkish lira, including taxes. The total payable, including any shipping fee and discounts, is shown at checkout before the order is completed.

Adding a product to the cart does not reserve the product or conclude a sales contract. The order is processed after payment is verified and an order confirmation is created.

If there is a stock error, a payment security issue, an obvious pricing error or a legal obstacle, the order may be cancelled. In this case the amount collected is refunded to the payment method without delay and the user is informed.

6. PAYMENT SECURITY

Payments are made through the authorised payment service providers offered on the site. The full card number and security code are not stored by the Company.

If an unauthorised or suspicious transaction is detected, additional verification may be requested or the order may be placed under security review.

7. DELIVERY, CANCELLATION AND RETURNS

Nothing in these terms limits the consumer's rights under mandatory law.

8. USER CONTENT AND REVIEWS

Reviews, ratings, images or other content submitted by users must be lawful, truthful and respect the rights of third parties. Posts containing insults, threats, misleading information, personal data breaches, advertising, spam or harmful links may not be published or may be removed.

For rights that are not non-transferable by nature, the user grants the Company a free, limited and revocable licence to publish the submitted content on the site, social media and customer communication channels. Personal data are processed in accordance with the relevant privacy notice.

9. INTELLECTUAL PROPERTY

Unless otherwise stated, rights in the trademarks, logos, designs, texts, product descriptions, photographs, videos, sounds, graphics and software on the site belong to the Company or the relevant right holders.

Content may not be copied, reproduced, modified, published or used on another platform for commercial purposes without written permission.

10. THIRD-PARTY SERVICES AND LINKS

The site may work with third-party systems for payment, shipping, analytics, customer communication or other services and may link to third-party sites. The terms of use and privacy terms of those services apply.

The Company is not responsible for the content or security of third-party sites outside its control. The Company's legal responsibilities in selecting and providing the service are reserved.

11. CONTINUITY OF SERVICE

Access to the site may be temporarily interrupted due to maintenance, security, technical failure or force majeure. Reasonable measures are taken to keep the service secure and running smoothly.

The Company cannot be held liable for interruptions caused by events beyond its reasonable control and outside its fault or legal liability.

12. PERSONAL DATA AND COOKIES

The principles for processing personal data are explained in the Privacy and Personal Data Protection Notice. Non-essential cookies run according to the user's preference.

13. CHANGES

These terms may be updated in line with changes in legislation or site services. The current text applies from the date of publication. Orders completed earlier remain subject to the contract and terms accepted on the order date.

14. GOVERNING LAW AND DISPUTES

These terms are governed by the laws of the Republic of Turkey. Consumers may apply, within the applicable monetary limits, to the Consumer Arbitration Committee at their place of residence or where the transaction took place, and otherwise to the competent Consumer Court.

This provision does not remove the user's application and jurisdiction rights under mandatory law.
